Income tax underpaid/overpaid

My son has just received a letter stating that he has underpaid tax up to april 2013. After some investigation we remembered he was given a cheque for a similar amount a couple of years ago as he had "overpaid" tax. If they are now saying that this was a mistake can we argue that as it was their mistake he does not have to repay "underpaid" tax. Thanks for any help

    The answer is no, your son cannot refuse to pay tax because of an error by HMRC.

    Surely if he had received a cheque 'a couple of years ago' this would have no relation to the tax due for 2012/13?

    If you want someone to check this you have to give the full figures.
