bankruptcy restriction order

Hi all! I declared myself bankrupt Nov 2008 and was discharged exactly one year later. At the time of discharge I was served with a restriction order which ran from Nov 2009 until April 2012. This order still appears on my credit report albeit it does state the end date.
This Nov all of my bankruptcy info and defaulted accounts will be removed from my credit reports!! Yay! But I have discovered today that the restriction order will remain on my report for six years from the issue date which therefore means it will stay on my report until Nov 2015. Is this correct? I was feeling so relieved about having a clean report but now I'm seriously fed up that I will continue to struggle to pass credit checks due to this. Please somebody advise??? Thank you

    Hi,

Interesting question, and I'm afraid I don't know the answer as CRA's are not my strong point.
Perhaps the official Experian representative on here could help us out with this one?

  • That sounds right to me.

The effect of a BRO is to extend the effects of bankruptcy. So if you extend bankruptcy by three years, then it will fall of your account three years later.

Bankruptcies held for six years from the start date as long as discharged within that time, so yours should go in November. The restrictions order (BRO) has the effect of extending the bankruptcy period, but as your BRO did not extend beyond the standard six year period it should all disappear after the original six years - that is my understanding anyway. If this doesn't happen automatically please give us a shout.
