Hi everyone.
New to the forum but think its great place to chat.
My dilemma is I sold a car to a work colleague and agreed instalment payments over a period of time. In the meantime I kept the log book under my name for obvious reasons until the payments were completed. My colleague started to receive parking penalty tickets, and of course this landed on my door step as keeper of the vehicle. One penalty ticket has been rejected on appeal and the council have advised I am reasponsible as the keeper, even though I was not the driver at the time,despite me sending documentations showing the sale of the vehicle. I have been asked to apply for judicial review as a last resort. My colleague has since left my place of work and will not respond. Your opinions will be greatly appreciated as it seems so unfair I should pay for someone else's mistakes?

This post really isn't in the right forum...you need to post on the motoring forum.
However, I will respond to some of your question.
Your retention of the V5c [what you refer to as the 'log book?] is the big mistake.
The log book identifies the Registered Keeper...and states specifically on the front, that the RK may not be the actual owner of the vehicle.
You are ..as the Registered Keeper, legally responsible for that vehicle....and what it does.
You may well find yourself on the receiving end of a fine from DVLA for failing to notify them of a transfer of Registered Keeper.
Sadly, too many people fail to understand the difference between vehicle ownership...and the Registered Keeper.
You need to obtain your colleague's address quickly.....complete the V5c as required, and send to DVLA.
This will be a matter of urgency...since if your colleague triggers a speeding fine, for example, you, as the RK, will be legally required to provide the name of the driver ..and address....if you cannot do so, you yourself may end up in Court.
As to fairness?
Well, you were suckered by ignorance..ie, failing to read what is written on the V5c for starters.......[are you aware, you yourself will be responsible for ensuring that vehicle is continuously insured?]
You need to take steps to rectify the V5c situation as above..before any more letters pop through your letterbox?
And, consider your experience as a 'lesson learnt'.....?No, I don't think all other drivers are idiots......but some are determined to change my mind.......0 -

Are you sure it is a Judicial Review you are considering? JD's are fairly hefty and expensive legal processes that are not intended to determine whether a decision is right or not - only whether the correct processes have been followed by a public body. I would think, as alastairq says - the process was fine - its just the decision you are unhappy about. However, because you failed to understand the rules I doubt there is much you can do about it - you are the RK and as such you are responsible for the fines, tough but unfortunately true.0
