In total panic . Filed for bankruptcy in jan . Teacher from Ireland . Husband is from uk. Serious negative equity and debt on apt costs out of control. Judge suspicious of comi. Postponed until hearing in march. Paid a cowboy 2000 who does not seem to know how to advice me. Arrived last August. My name not on first lease ( not working pregnant at time . Subsequent miscarriage )stayed 5 weeks in first house. New house/ lease with my name from oct. proof utility bills / daughter pre school/ council tax etcand . Worries have screwed up centre main interest uk.difficult to prove as joint account with husband. Since submitted flight home details / bank statements / anything can think of. So frustrated . Worred cause judge said should have told creditors of plans to go bankrupt . I informed then I had moved to Uk as that was what I was advised to. Forgot to put myself on electoral role ( since applied) should I hire legal representation at this stage ( post witness statement and supplementary documents in support of comi)???!anything else I can do to support comi??are my creditors likely to appear at hearing now that court has told them of hearing ? ?? Please help as have spoken to cab and insolvency helpline and have v lil money as one sole wage of my husband

  • Your husband has always lived in England?

You used to live in Ireland but are saying you moved your COMI to England in August BUT you are now planning on returning to Ireland?

    Is that correct?
  • This does have an air of attempting to avoid the stricter insolvency regime in Ireland.
