CCJ threat 6 year old debt
miss-tified
hello
I'm pretty new, hoping for help
I have ignored all debts and associated correspondence etc for almost 6 years (ending June 2014), replied to nothing, today got notification of possible CCJ. Debt has been sold on several times since 2008.
I'm unemployed, have no assets, no money. I've read that if a debt goes beyong 6 years then they can't reclaim it, so its about 4 months away from my 6 years.
I don't know what to do about this CCJ notification. Apparently, if I acknowledge it then it re-starts the clock. If I ignore it and try and stretch things out until the 6 years is up then maybe I have a chance of eliminating everything? Or will they send the baliffs?
Please can anyone help with advice or point me in the right direction? Sorry if I've posted this in the wrong place.
I've trawled so many websites, getting really confused and increasingly desperate.
Thank you!

well if they get a ccj it starts againDon't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0

thank you for your reply.
do you know what might happennif i just ignore the threat about the CCJ?0 -
I would guess this is a last ditch attempt to get you to acknowledge the debt as they know it is about to go SB and then they have no hope of recovering it. Who did this notification come from? What sort of debt is it? Who was it with originally and when was the account opened?
I wouldn't anything yet, someone with more knowledge of CCJ's should be along to help.0 -
Is it a ccj notification or just a letter saying may, or might or if?
And who is it from?I'm Debt Free :j 2/09/2013

No bailiffs unless they get a ccj, no ccj unless they can prove the debt is yours.
So, let's have a bit more info so we know who we are dealing with.
You will begin by sending a prove it letter to see what, if anything, the sharks have. A template can be found in the stickies above, so that is your first job.
Your asking THEM to prove that YOU owe them, not the other way round.I'm Debt Free :j 2/09/2013

Thanks so much for the replies.
The notification came from a debt collection agency. The original debt was with mainsteam high street bank for an overdraft. The debt started in June/July 2008 and I ignored eveything (post, phone calls, etc) and have no contact whatsoever since then.
The notification states that the debt is from 2011 and I'm guessing this could be when the debt was sold on to the current debt collection agency.
I went to Citizens Advice Bureau today (just got general advice really) and have another appointment there next Thursday with Mary Ward (?) apparently specialists in this kind of thing.
According to the notification I have only 14 days to reply, so my time is shrinking, as is my brain, and I think my options too.
Sorry if all this seems like I can't organise my own life, I know I have to do something but the more I try and research possible options, the more confused I become.
Thanks again to everyone that replied.0 -
What sort of notification is this, because if it isn't an actual claim from the court it's just a threat o gram from numb nuts DCA.
Which DCA is it?
You need to send the prove it letter in the link I provided earlier and send it, recorded delivery, tomorrow.
This will stop them in their tracks because knowing DCAs as I do, they won't have anything and are hoping you won't respond.
Send the prove it, sit back, and wait.I'm Debt Free :j 2/09/2013

Its a Claim Form (says "Claim Form" at the top), submitted by DCA MKDP, part of Keens Collections. It seems like I have to send them a statement of income/expenditure and try for a Debt Manangement Plan maybe £1 per week. Will know more after my next meeting with CAB.
Thanks for your reply and advice ;-)0 -
I wouldn't do this. They are trying it on. Don't acknowledge the debt in writing at all. Don't offer any payment plan. Do the 'prove it' as above. Their whole aim at this point is to get you to acknowledge the debt before June this year. I would be very wary indeed of doing that. There are things you can do to play for time. Go for the 'prove it'. If they get back to you, write another vague letter asking for more clarification as you don't know what they are talking about. Put in a complaint of harassment in writing etc. Just bluff them along. Say you are not sure why they are chasing you and will go to the FOS etc. Do it all in writing to drag it out but NEVER acknowledge the debt or offer any form of payment.
Don't send them a statement of income etc. It's none of their business.0
