CCJ will I get one?

Just wondering how likely is it to get a CCJ issued while in a DMP?

Has anyone got 1?

Also If I do and when the 6 years go past and it drops off do you have to declare it in forms etc?

  • If the debt is with the original creditors still, it is unlikely it will get that far, on the basis that you are paying consistently towards clearing the balances. Even if it did become a CCJ, the court would only make you pay back what you can afford, which has already been worked out on your DMP. The costs of going that far would more than likely outweigh any benefits of going down that route.

    The chances per creditor are really quite low. But if you've got a lot of creditors, and if your plan is a long one, say more than 5 years, or if you own your property and the creditor knows this, then the chances increase.

    If you want some rough numbers, I probably deal with 600 'debts' per year at the CAB and get to help people with four or five court claims.

    Having said that, my gut feeling is that court action is increasing.
