What can I do to force ex husband to take his current mortgage offer

    You need to remain with focussed on your issue. In that you have exchanged without the funds to complete. Is your solicitor aware? Has he/she spelt out the danger you face?
  • Solicitor has been aware of the mortgage condition. I have tried but missed him today. We may just have to get a bridging loan, if possible

    He has said he has a mortgage offer with Halifax but it works out to £10k more a year than what he's paying.

    But really I have no prove that this offer is real either I guess

    He may have a mortgage offer but you've also written than he's obtained it through providing fraudulent information about his brother's earnings (assuming I've read your post correctly, of course).

    If the lender finds out before the transfer / remortgage completes, they will in all likelihood pull the offer and put a whopping black mark against his name for any future credit application.

    I agree with Thrugelmir that you need to speak to your solicitor pronto, and bridging finance may be your only option, but you need to consider whether there is the risk that his plan may fall through.
  • Apparently (from his close friends) he may just be punishing me for divorcing him and moving on. Its part of his MO of emotional abuse. And as a trustee for a domestic violence charity I understand this (but still persevered), DV is not just physical but emotional and other forms of abuse.


    Tomorrow is our daughters 15th birthday, and although he's taken her, something I did not want happening, he had asked me to contribute which I declined. Declined after last month he was in Japan skiing for 10 days, Nov he was in St Lucia for a weekend, June Barbados for 10 days and July America to just go and see a music award


    Somehow stands to reason that he would do this. I'm off tomorrow to divorce solicitor and also conveyancing solicitor. As much as I have been nice and accommodating, I can no longer. My fists are strapped and boxing gloves on (I box from time to time)
  • I've had no further response from my ex. I've decided that I'm going to move back into the house. He changed the locks and since he's away I will do the same. Since I am still on the mortgage and deeds I have every right to go back. It will make him and things very uncomfortable but he needs to take on this bridging loan and take me off sharp.

    Only making this comment as a neutral observer.

    Raising the temperature is likely to make your ex even more obstructive. Not wise given the financial exposure you have having exchanged contracts. I can only repeat it's your problem in the short term. Don't play hardball if you're not wearing protective clothing.

    My divorce solicitor is shocked that my convancying solicitor knowing about the condition of the mortgage went ahead with exchange. I know and recognise this is my problem. She's advised that solicitor indemnifies us against damages, and if we don't make completion it's up to vendors solicitor to then force the completion. We hope it doesn't get to this.

    My divorce solicitor has also sent a firm email to ex husband, highlighting that failure to complete consent order can carting a prison sentance (part of consent order) which he signed and agreed to. She also highlighted to him that there is a court date for the 12th March, where I would be pushing for sale and compensation from the proceeds. There's over £200k in equity.

    This weeks going to be so hard, but it's in his his and interest to sort it out. He should now understand the seriousness.

    Well by the grace of God we completed on Tuesday 4th. Monday was panic stations as our solicitor only then got around to send us our bill so Tuesday was first in line at the bank sending CHAPS payment.Then later vendor fuming as funds not received by the time he had wanted (12.30). He went on to tell us that he would be telling his solicitor to push for a Sale of Completion order, meaning we would pay for his drivers / delays. In all that the BT engineer turns up. Appt between 1 and 6pm and she turns up at 12.30. The mad vendor then gets abusive and drags her down the stairs. Engineer then tells him she's calling the police. He then calls us to hurry up the transfer (but it had already left our solicitors) as he wants to leave. Due to his behaviour wasn't happy to meet him to have the keys handed over and we called the EA. She then has a word with him, and informs him that we in fact completed 20 mins before.Drama... but we are so, so happy we got the keys. And have spent the last few days shopping like crazy, as we have nothing for a home.Good luck to all going through this awful, awful buying process.
