The Operator issued parking charge notice number xxxx arising
out of the presence at on private land, of a vehicle with registration
mark xxxx.
The Appellant appealed against liability for the parking charge.
The Assessor has considered the evidence of both parties and has
determined that the appeal be allowed.
The Assessor’s reasons are as set out.
The Operator should now cancel the parking charge notice forthwith.
Reasons for the Assessor’s Determination
The Operator issued parking charge notice number xxx arising out of
the presence at on private land, of a vehicle with registration mark xxxx.
The Appellant has made a number of submissions, including the fact that the
parking charge is not a genuine pre-estimate of loss.
The Operator has not sent in an evidence pack to contest the case but they
have emailed to say the following: “Please be advised ECP will not be
providing a POPLA evidence pack regarding case xxxx. The basis of
appeal to POPLA has no reference to the original appeal received. Please
close the case”.
As the Operator has not addressed the Appellant’s points, I must allow this
appeal in favour of the Appellant.
Accordingly, this appeal is allowed.

Well, there goes another CoP breach:22.16 - You must keep to the processes and other requirements of POPLA, as set out in their Code of Practice and elsewhere.
2/1 on that nowt happens though if the OP complains. I'd just bet a pound to a pinch that POPLA won't be complaining - though I'd loved to be proved wrong.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).

I note from your original thread that you submitted the counterclaim clause in the initial appeal - did you follow the thread to include that if the POPLA appeal was upheld for ANY reason (wording applicable for your appeal)? - You may wish to raise a claim for your costs now:D

No I didn't include the wording. My costs were very carefully controlled..........what would you expect from a moneysavingexpert fan.:D

On top of your £54...
A couple of kilowatts of electricity, fourteen ml of printer ink, three staples, wear and tear on the carpet and signage costs (the house number...so the postman knew where to post the ppc letters).
I've done the sums for you and I genuinely estimate these losses at £100, reduced to £40 if paid within fourteen days.

Well done Nile and to all the regulars who do such an amazing job on this board on a daily basis. I often wonder how much money has not gone to the PPCs through all your wonderful work. If only we could quantify it. :cool:

I reckon on pepipoo and on here, we help with dozens of POPLA appeals every week, and they all win (except lesnmandy's which is being complained about).
Trouble is, we think only 1 or 2% of these ever get to POPLA stage, hence why some PPCs have stopped bothering to put up a fight when they see a forum-based POPLA appeal. If only we could take out an advert on TV that told people 'How to win at POPLA'!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
