Hi All,
I would like a little advice on behalf of my sister.
Basically, the issue is
four years ago, just before my sister broke up with her ex bf he taken out a load of payday loans in her name (online), the problem for her is, they all got paid into her bank account because he couldnt get one so they shared her's. now, she didnt know hence she keeps getting these letters four years later, she said shes paid a couple off already as shes trying to move on with her life and now another one.
the latest dates from april 2009, about 1 week before she left him.
the problem here is back then she was naive....
Shes going to go to citizens advice, but i just wondered if they was anything at all she has other then her word against his ?
the other problem she said was, she has signed up to experian, but there is no record of it, or the others on her file, and she doesnt know if there will be any others..
any help would be appreciated

There are 2 other credit ref agencies to check, she could check them, google credit ref agencies and open the 2 link after the top 3 sponsored links.0

As above. She needs to get copies of Equifax and CallCredit before going further.
Equifax is £2, Call Credit is free through Noddle.

I'm obviously naive, but how do you get a loan in someone else's name?
And didn't she notice the money going into her bank account? If not right away, she must have noticed it on her statements?
Why is she paying off loans that weren't hers?0 -
Well, if the story is 100% true, then, legally at least, the loans ARE hers.I'm obviously naive, but how do you get a loan in someone else's name?

Hi,
If she didn't know, what was done about CPA (continuous payment authority)? If this hadn't been stopped then money would be coming out of her account left right and centre and they would have been hounding her from the moment they started having problems?
Surely he would have had to apply in her name to get the money as her name would have had to have been given during the application process?
I think that Gaz83 is correct and legally the debt is hers as there is no evidence but is your sister not telling you the whole story perhaps?

She received the money for these loans that are in her name, so she is responsible for paying them back I'm afraid.
She could try taking her ex to court, but she's unlikely to have much chance of success.0 -
I'm pretty sure she has breached the conditions of her bank account by allowing someone not named on it access to funds - by sharing a single card, maybe? That's going to complicate things a lot.2021 GC £1365.71/ £24000

Payday lenders often allow one bank account for receiving the loan, and a different one to pay it back. That's makes them very, very fraudprone.0

Hey, no, my sister is 100% truthful, and i trust what she is saying as correct,
I said to her the problem is, because he used her account, like his own(which as said above is fraud anyway..) i didnt think she would have a leg to stand on...
he was a very controling person, and she said kept all of the statements so she couldnt exactly see what was going in and out, now, i did tell her she does need to go to the bank and see what they can tell her, but ultimately my thoughts where, the debt would like with her, because he used 'her' account, and taken payday loans out in 'her' name, with only an online signature required. its easy to get money if you know the info required,
she had also checked on noddle but nothing there either.
i know she closed the account, not long after she moved away, im guessing in the hope of starting a new life,
still, if theres nothing she can do, then i think the only option she has is to pay it.
thankyou all anyway..0
