Quick question


Quick question: We have an overpayment of C tax benefittotally approx. £3500. I have justrequested a SAR, as we are appealing.



BUT, I have also discovered that we are in the wrong Council Tax Band. We should be in Band A, and in fact are inBand B, which means we havebeen overpaying the councilfor 14 years!



When I have contacted the VOA and got the official valuation for our property, what kind of letter do I write to thecouncil to say, basically, “you take the value of our overpayment offthe value of your overpayment, and then we’ll see who comes out on top!”

    It can take several weeks for the VOA to deal with a request for a band review. Three points to consider.

    1) They may not agree a CT band reduction is warranted.

    2) Even if they do, I understand some councils are restricting refunds of overpayments to the past 7 years only.

    3) Even if you get a reduction and a full refund of all overpaid CT, this will be less than £3,500.

    I would just contact the council and ask if they can delay the request for the CT benefit repayment until the CT band query has been answered.
