advice neededon a natwest loan

Hi all and thank you for reading my post,

about 14 years ago i borrowed 10000 pounds from natwest bank in the form of a unsecured loan.
i was paying a doorstep collector for the last 6 years the balance of for this loan but the balance he gave me was different to the balance that natwest claimed i owed he said at the time that i should use his balance as well as that is what natwest had provided him with the balance in question was £2000 i have payment cards to prove that i was making regular payments to this account and have kept the payment card last 4 years for some reason in november 2013 the doorstep collector suddenly stopped coming to my address i now have westcott services chasing me for the debt and claiming I owe £9000 where do i stand on this.
do i only over the £2000 on my payment card or am i liable to pay the whole balance even though they have not chase that balance in nearly 14 years is the date still enforceable.
what i am most worried about is a fact that i have been playing a guy at the door for the last 4 years and balance maybe a disappeared all i have is to payment cards to prove i was ever paying him.

To answer your enforceable question, the debt it enforceable for 6 years since you last acknowledged it.

Acknowledgment is via writing or making a payment.

So if you made payments up to Nov 2013 then the debt is enforceable up to Nov 2019.

Even after the 6 years, they can still chase the debt they just cannot take you to court.

You also need to ask Natwest (or wescott) to prove who they assigned the debt to, I assume the doorstep collector gave proof they actually owned the debt?
  • thank you for your reply it seems i have a good homework to do

  • It's enforceable, as long as Wescott have the signed original CCA. On a debt that old, it might well have vanished.

I would send them a CCA request to find out what they have. Without it, any court threats they make can be defended easily enough.

At the same time, try and find out what's going on by disputing the balance with Wescott, in writing.
