Can someone please explain this?

Woman on the phone was useless and made no sense.

2012 scheme

Ex has to pay £104.63 a month/£24.06 a month (we'll see about that,he couldn't afford what he has/does on the given income)

I have a schedule for payments for a year 20/2/14 - 20/1/15 giving those payments.

The liability started on 21st December.

Calculation shows that the amount give is the actual amount based on given income,nothing added.

However,apparently the arrears from December to January are included in those payments and spread across the year.

It makes no sense to me because nothing is added.

Woman said 'yes it's included',yet couldn't see how but said the annual reassessment will be done in December ready to start over in January.

Can anyone explain?!?!?

  • It sounds like you have received an expected payment plan. Is it telling you that you will receive 11 monthly payments from 20/02/14 to 29/01/15, I.e. the first payment will be on 20th Feb, or 10 monthly payments, I.e. the first payment will be on 20th March?

    It might be helpful if you could quote exactly from the letter, so we can help you figure out what's going on. Also, do you have another letter, or maybe it's included in the same one, telling you what the income is that has been used and how they've worked out your calculation? That would probably help too.

    Also, have you received any payments since 21st December, either via CMS or direct from the NRP?
    I often use a tablet to post, so sometimes my posts will have random letters inserted, or entirely the wrong word if autocorrect is trying to wind me up. Hopefully you'll still know what I mean.

    I've received nothing payment wise.

    The letter I received states payments collected on 20/2/14 to 20/1/15.

    The letter also states that arrears are not included in those payments.

    Liability from 21st December.

    Income given is £225.30 a week after pension (hilarious)

    There is a reduction due to him having a baby.

    Payments are £24.06 a week.

    I phoned to ask about the arrears (from 21st December onwards) as the letter says no arrears are included in the calculations and any would be dealt with desperately.

    The woman I talked to had to check and phone me back because e wanted 'to get the explanation straight'.

    Her explanation was just that it is included and split over the schedule given.The annual review/reassessment will be in December ready to start when this schedule ends in January.

    I asked how it's included as it says it isn't and there is no difference in what the payments would be.

    She said it is and repeated the same thing again followed by 'exactly what is so hard for you to understand?' !!!

    Still makes zero sense to me as the review in December will only kick in in January.

    Confused!!!!!!

    Not much point quoting from the letter as it's pages of pointless tosh tbh!

    Should add,the expected payments runs for 12 months Feb-Jan.

    She said that those payments add up to the normal years payment therefore arrears are included (which makes no sense) and a new assessment will then kick in in January.

  • Right, so is she saying the payment due on 20/02/14 is covering maintenance due from 21/12/13 - 20/01/14? I.e, you're running further in arrears than was normal for CS2? So if your case were to close on 21/12/14, you would still be due the payment on 20/01/15.

    And yes, I was getting muddled in my mind, if the first payment is 20/02/14 and last is 20/01/15 that would be 12 not 11 payments. Silly me.

    But then the review which kicks in in January won't be due for payment until feb ,so does that pan out???wouldn't that still leave a month missing somewhere?

  • If the liability started on 21st December then the annual review process will kick off around 21st November. The paying parent will get a letter at that point more or less saying 'Based on your last tax year, your new assessment will be £x per week, from 21st December. Contact us if you disagree with the assessment'. I assumed that a new promise to pay schedule would be issued then as well, so the first payment of the new assessment would then be due around 21st Jan 2015?

    That's my understanding anyways.
