Help with Moorcroft cca request.

  • Yep, send them a letter referencing theirs and state that you are still writing for the response to the CCA request.

    Moroncroft have many different depts. and one doesn't always know what the other is doing, the recent letter is most likely computer generated.
    They are perfectly well aware of there responsibly here, they are hoping you aren't as clued up, keep us informed.

    Thanks for all your help, I sent them a reminder that they were in default of the cca request included dates etc. and the fact that they had signed for receipt of the letters. Today we receive a letter from them saying that as they haven't received any communication from us they feel that we are not in a position to meet the request to clear the account and offering us a repayment instalment plan ...... basically not acknowledging our last letter to them. The letter is dated 3 days after there receipt of the letter I sent. Looking at the letter it looks like its an auto generated letter to get us to phone them which I will not do.

    Any idea's how to continue with this.

    They are earning their nickname of Moroncroft.

    Maybe start pestering them back.

    For example send the letter to [EMAIL="enquiries@moorgroup.com"]enquiries@moorgroup.com[/EMAIL] and [EMAIL="andrewmcroberts@moorgroup.com"]andrewmcroberts@moorgroup.com[/EMAIL] with a complaint saying you will be taking them to the FOS, CSA and reporting them to the OFT.

    Then keep sending the email every day. ;)

    Well before I got chance to send an email we receive another letter from them which is as follows

    Thank you for your recent letter. At this stage we are currently unable to provide a copy of the agreement as we have been in contact with our clients (studio Cards and Gifts) who have confirmed that the original credit agreement was sent with your clients first invoice and they were instructed to keep the documentation in a safe place.
    If there are any areas where you feel that a dispute in relation to the account still requires resolution, please provide details and we will be happy to try to assist you. If this is not the case we look forward to receiving your settlement proposals.

    Not at all. That is all but an admission that they are stuffed while they can't provide the agreement, and that they never obtained a signed and executed agreement in the first place.

    What utter and complete tripe.
    I suggest you respond with a letter reminding them of there clients obligation under section 78 of the consumer credit act 1974.
    A debtor has the right to a copy of there original agreement, or a reconstituted version, at any time while the account is still active.
    Until such time as this is received, the account is unenforceable in court.
    If they are saying they don't hold a copy themselves, then they must clarify this, until then, you will with hold all payment to them.
