Dealing with OR

Dear all

Staring down the barrel of BR- giving in forms to court this week...
Any views/experience on these queries?
I was made redundant over 2 years ago and put my payout into a relative's account- I wanted to keep some kind of saving & didn't want the temptation of a pile on money sitting in my account.
The plan was to get another job quick but as it happened I became ill and couldn't work- I am on ESA.
I continued to pay creditors and living expenses by gradually drawing out money but now I can't go on, hence BR.
Also last year I paid a builder about £3k to do so work in the house- he insisted on cash, I have no paperwork and he has since gone back to Poland.

Any idea on how the OR will see these 2 things?
Really just want the 1 year of pain rather than being hit with a BRO

  • How large was the redundancy payout? Are you saying that you have now spent it all on living expenses?

    Did you have no paper communications with the builder at all? No emails about start dates?

    How much equity is there in your house? What are your total debts?

    In answer to your questions-
    - payout was under 30k
    -all of it was spent on living expenses + keeping payments to creditors going for past 3 years
    -Nope, builder recommended by a friend, came round gave a quote and wanted payment in cash- do have before & after pics of work though
    I live in a rented house- total debts around 30k
  • Your bank statements will show your living expenses and payments to creditors. As long as you can explain the cash withdrawal to the builder, you have proof of what you spent your redundancy money on.

    The OR is used to changes in circumstances pushing people into BR and they are not there to catch you out. My OR was very reasonable and non judgemental, he just has a job to do. Try not to worry, BR seems daunting at the beginning of the process, but once you get the wheels spinning, it's not as bad as you imagine and you can look forward to a fresh start.
  • The OR may well ask why you spent 3k on repairing a house that doesn't belong to you.
