Raise a complaint with the FOS

attach your original refund letter and proof of posting and state all the various stalling excuses they have come up with (dates and times of calls, copies of emails). Please keep all correspondence in writing for this reason, phonecalls and emails are difficult to use as evidence.

    http://www.financial-ombudsman.org.uk/consumer/complaints.htm

Also send a copy to the finance Facility to make them aware they aren't going to get away with it. You may find a refund arrives before the FOS get to grips with it.
  • MissGeordie - I have to say I admire your persistance given that you have been trying to get this £69 back for 9 months now.

Many lesser Fools would have given up by now and put it down to experience - which is probably what TFF are hoping for!
  • I too have been fleeced by this company but they are not going to get away with it. Hopefully I'll get them closed down. The people you speak to are liars and conmen. BEWARE.

What is wrong with you people that are writing unfair comments when someone clearly is asking for help?

I suggest you comment on an area that maybe you can actually help people instead of making them feel worse!!!!

    Hi Lin

I also applied for a loan and didn't notice their terms and conditions online, my situation was slightly different as the website crashed and on my mobile before I got this point and they agreed the application anyway. They then called me and told me about the deduction of 50p and asked for my debit card details and hey presto took £69.95 fee. The law states that the money has to be returned if you do not use their services within 6 months but getting it back is the problem.I left chasing for around 1 year and totally forgot about it until 2 weeks ago. They claimed they didn't know who I was and reference I quoted wasn't theirs (even though they gave it to me).I am chasing up today as they wanted around 1 week to look into it. They first claimed my case was closed and said they only do that when a refund or loan has been given so I am looking forward to yet again another argument.

    I will keep you posted.
  • Hi Lin

I am chasing mine up today, how did you get on?
  • For anyone that is following this thread please see below the action I am following today to get my money back using The Financial Ombudsman-

    1. complain to your bank, insurance company or finance firm

It's important that you complain first to the business you're unhappy with – and give them a chance to look into your problem. They have eight weeks to do this. We can help by contacting the business for you, and telling them about your complaint.

    phone our consumer helpline on
    0300 123 9 123 or 0800 023 4567
    Monday to Friday – 8am to 8pm
    Saturday – 9am to 1pm
we'll be happy to phone you back

I have called them today and basically you have 3 years to make the complaint against the company. They will send out a standard letter for you stating your complaint/issue with the company, the company have 8 weeks to respond, normally in this period of time they would just send the refund otherwise the Ombudsman charge £500 per complaint they handle. For those that do not complain then this company are making a huge profit, I only wish I had applied earlier through the Ombudsman. I will post the outcome.

Mine is with the FOS, Finance Facility didnt get back to them either so it is going to the ombudsman I should find out the result after 9/4.

I would recommend going to the FOS otherwise they will continue to do this, the FOS agreed that the fee was hidden so its not as simple as you knew you shouldn't have signed up.

can anyone advise on my situation with this company. they never mentioned the £80 fee on the call only the 50p. and then only after trying to collect it from my bank when i had no money in it. i received 1 loan offer but that was not completed as they required a guarantor. i have now emailed them complaining of misrepresentation and never mentioning the charge. i have also stated that if they attempt to debit my bank account then it will be considered fraud.
As i have done this, have not accepted any offer and they have yet to debit my account-with no money in it anyway can they keep trying to collect the fee - there certainly wont be any money in there till next month now but i dont want my bank account to be held to ransom for the next 6 months
