Collectica - can they enter my property?

Yet again, I have received a letter from a debt collector for someone who does not live at my address. I posted before about Marstons as their bailif called at my property when I was out and left a notice saying they would come back and force entry to remove goods - the debt was for unpaid council tax I had to spend my time and money phoning and writing to prove that I was the owner of the house and had never heard of the person they were chasing.

I eventually got Marstons off my back and now I have Collectica chasing an unpaid speeding fine and threatening that they will enforce entry to my property if the debt is not paid within 7 days.

I have just called them to explain the person does not live at my address and they will only remove my address from their records if I send them a copy of my council tax bill - should I do this?

I argued with the woman that they could quite easily check the electoral roll but she said they didn't do that, and hung up on me!

How do these companies get away with treating innocent people like me in this way? :(

  • Perhaps you could go direct to the Magistrates Court, and inform them, that the offender doesn't live at your address.

    Tell them to go forth and multiply , they can't force entry to your home and steal stuff that doesn't belong to them it's called breaking and entering and theft , Inform them politely that you are the new tennant/owner and will immediately file a form four against their company if the persist in harassing you , if they do turn up you only need show them a copy of your tenancy to prove it anyway

    Sending evidence to show that you're not the liable person is worth doing. It's very, very unlikely that they'll actually force entry. I think Bedsit Bob's is worth following for sure. I hope you get it sorted.

  • I own the house and I'm out at work all day so worried they will turn up and break in. The document is a Notice of Distress Warrant.

    I will send them a copy of my council tax bill to get rid of them. I've been returning mail to sender for the person they are after for 2 years so he must have a lot of unpaid debts. Just when I think it is finished another letter arrives. Last time I came home to find the bailiffs letter taped to my front door!

    Puffytat, I have the same problem. Had sent back a red letter to the Enforcement Agency advising that x was unknown at this address but received another red letter today and, under separate cover, a debt notice from Collectica. I'd already rung the Enforcement Agency but this had clearly had no effect, so I rang Collectica. They said I had to (HAD to) provide proof of residence. I was speechless, and when I said I was the innocent party and had no intention of doing so, I was told that there was absolutely no point in having rung to advise them if I wasn't prepared to do what they wanted. When I asked for customer complaints "No, I'm not going to put you through. There's no point". I said this was poor customer service. "You have no complaint, you're not our customer". Vile, vile person. Patronising and a bully. Going to look into Form 4 mentioned above. I managed to get rid of TV Licensing (no telly) using MSE help. Maybe, I can get rid of this crowd too.

  • Don't know if this is possible or if it's even doable, but it might be worth going to the police with as much documentation of their threats as possible to report a pre-planned burglary on your property.

    That's what it is, after all. They're apparently sending someone round to enter and take property that doesn't belong to them and is not theirs to take as it's not linked to any debts you have with them.

    It's up to THEM to prove the person they are after lives there, not for you to prove otherwise.

    They should do correct checks.
