Cant Change Payment Date

Please be gentle first post :-) I hope this is in the right place, I have searched and couldn't find anything relating to the exact issue.
My other half has a car on HP, the company allows for two payment date changes over the life of the finance, it was changed firstly when it was first set up as it was a random date then secondly changed last November due to a new job and different pay date. It has been coming out of the bank account fine since last november on the new date but this month they took a payment on the 2nd of the month then attempted to take payment on the 28th of the month (old payment date) so two payments in one month.


OH phoned to see what was going on, they basically said that their computer systems somehow has reset things and has gone back to the old payment date, but because they see this as a payment change they are refusing to put it back to the 2nd of the month.

I know that if it doesnt come out on the 2nd it would come out on the 28th and the HP will get payed but can they just change the date on us and not inform us? As they attempted to take the second payment of the month the money just wasn't there and we have got charges from the bank.

Any thoughts and help would be greatly appreciated

    If this is a Direct Debit I would point out the terms of the DD Guarantee to them:
    • If there are any changes to the amount, date or frequency of your Direct Debit the organisation will notify you (normally 10 working days) in advance of your account being debited or as otherwise agreed. If you request the organisation to collect a payment, confirmation of the amount and date will be given to you at the time of the request.
    • If an error is made in the payment of your Direct Debit, by the organisation or your bank or building society, you are entitled to a full and immediate refund of the amount paid from your bank or building society.

    Do you think they will move the payment date back or as it would technically be the third date change they will stand their ground even though it's their mistake?

    I would point out that according to the DD guarantee they cannot change the date without giving notice and either way there is no way they can count their mistake as your second date move.

    Ask them to send you a copy of their complaints procedure if they continue being silly.
