I'm in a similar position. As part of the consent order he paid me a lump sum (minus half his CC bills of 24k, as he argued it was a family debt, and I wanted a quick clean break) and had to remove me off the mortgage. A year on and being unable to get a mortgage with my new partner, I've submitted a D11 form to the family court. Court date 12th March. This still gives him an opportunity to get me the HELL OFF..... I'm also asking for compensation, or if the house sold a share (minus lump sum) of the equity.
He's in the past had 4 attempts, and failed due to affordability. He's since disclosed to me (after I failed first attempt to get a mortgage) that he had been spending the last 6 mths trying to 'raise' his brothers wage to meet the requirement of the affordability... this all by some fraudulent manner.
I have no associations with him at all apart from this mortgage, and made sure all my credit files and agreements are up to date. I'm waiting for the date now for him to explain the whys, and then I can put my side forward. We have a 15yr old daughter, and have joint residency and maintenance (non existent), so hope the need to provide until her 16th fades away. I'm currently at my mothers and really need to move out and on:(:(0 -

In any dispute between warring factions the Court automatically takes the on the role of guardianship of the children. Any decision by the Court will have the welfare of the children as it's foremost priority. Anything else is secondary.0
