Should my employer tell me about SSP

I am feeling a bit stupid as due to my guilt on ongoing time off sick I thought it would be best 2 weeks ago to say to my employer that I would leave as I am too sick to work.


I did not realise that I would be entitled to SSP. I do not have a contract (which I know is not right but just the way it is). I have worked for the company for 5 years.


Is there any due of care on the part of the employer to tell me about SSP ....


I am too ill to work and cannot see a time when this will change.

    You have had time off sick and resigned? Why?

    What do you mean are they responsible to tell you about SSP?

    if you had been sending fit notes in, your employer would have paid you SSP automatically if you fit the criteria.


    How many hours did you work, what was your wage.




    Bit daft resigning, you accrue holiday pay whilst off sick.

    I was working part time but earning approximately 240 a week based on 20 hours. I know they were getting !!!!ed off about me being off sick, so they altered my hours from nearly full time to 20 hours per week. Was very ill over Christmas and just felt it wrong to keep taking time off and thought it would be better to leave so I did not feel guilt or pressure. I did not realise I was entitled to SSP - sounds stupid but did not know. We do not have contracts or anything in writing about terms of contract at all, small company that do not work like that.


    I was wondering if there is any duty of care that the employer should ensure the employer should ensure the employee knows what their entitlements are, so should they have told me to stay sick and not resign. Sounds mad but feel stupid. They have not asked for any sick notes and do trust me that I am genuinely ill. They have even told me I can come back if I ever want to ...

    They have a duty of care but you have a duty to know your rights. I think you need to spend some serious time reading and work out what htey owe you if anything.
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

    After seven days sick you must send in fit-notes in order to get SSP. If you've been ill that long you must have seen your GP?

    You do have a contract by working there even if not written down.

    Yup I totally acknowledge that I should have known my rights, but have been horribly ill and struggling to work and that consumed me so I totally ignored what I should have been checking out. I feel stupid that I wrote in saying I was too ill to work and thought it better that I should leave. As they had been helping me out my adjusting my hours I felt guilt that I was going to be off work again.


    Emotionally I was worn down and just exhausted. Unfortunately chronic illness takes away some of the normal thoughts as just struggle to eat, work out medication and feel absolutely grim.


    I was hoping that there might be a way that I should have been advised by the employer.

    I have seen my GP repeatedly with regard to different aspects of my illness but have not had to provide any certification to my employer. I have ME and have struggled into work for a day, then gone off sick, then back in, then worked from home, then off sick, then in ... so I have not been off sick for 7 days in succession but would have been as I could not carry on.

    I knew I felt so ill that I could just not keep on struggling to try and work. The ME drains me from the moment I wake up to the end of the day. Even when I was working I had severe nausea and just tried to get through a few hours before I would have to leave. I just got to a point when I just woke up and knew I could not carry on worrying each and every day that I was letting people down, felt pressure that as working in a small business that it was difficult for them.

    You should still have sent in fit notes, for whenever you were off sick, no company will pay you sick pay without them.


    You need to ring the DWP up now to try to claim any benefits you are entitled to. Ring them aSAP
    make the most of it, we are only here for the weekend.

    Fit notes are only required where absence length is more than 7 days ..for absences up to 7 days you self certificate. In fact my gp will not issue fit notes for illness with less than 7 days absence from work.
