Rights to car - finance in partners name
Hello, please could someone give me some advice on this. My partner got finance on a new car for me (I traded my old one in) because of my poor credit score I couldn't apply. I have paid the payments for the last year and it's a five year deal. He is the registered keeper on the log book also. It gets a bit more tricky as I have been using his bank account (with his permission) to have my salary paid into and the payment gone out etc. During a recent argument he threatened to take the car from me, can he legally do this even though he hasn't paid anything towards the car?

If he chooses to take the car then I would be thinking about
1. getting my wages paid into my own bank account to protect them
2. give him the car and tell him to continue with the payments
3. think of a new place to live
If a partner of mine ever threatened me with something like this then the relationship is not founded on trust and mutual respect.
Do you want him to have complete control over you and your finances.

Do you want him to have complete control over you and your finances.
That's reasonable from one perspective, alternatively I probably wouldnt want to be in a relationship with someone who's control and understanding of finances meant that I had to do that in teh first place.

agreed bigadaj, unfortunately there are a lot of people who find themselves in this sort of position and when the SHTF have no idea how they got there.
Time to re-evaluate I think.

One it's still the property of the finance company really.
Two I would not worry about the car. I'd be more concerned he could cut off your finances ANY time.
Get a basic bank account, get your own money in your own account. Then let him have the car, he can then make the payments on it.
Or you could keep paying and he VT's it half way through out of spite and you've got nothing to show for it.

Is this a relationship you want to continue with or is it heading in the wrong direction?
Proving the car is yours could take time and money. If your planning on moving on then stop your wages going into his account and tell him do what he wants with the car. If he doesnt pay for it then thats his problem not yours.
All the finance is in his name (i presume) So he needs to keep up the payments on it. Not your problem.

I would be tempted to park the car somewhere and say. Its all yours. Giving them the keys.
