    I wonder if you are looking at a credit report entry by the catalogue company, and BC are acting on behalf of whoever now owns the debt, like Lowell Financial.

    It is likely that you will receive a claim form, and a s78 request would be a good tactic if you can get your request in ahead of their claim form.

    Well the debt that is showing as satisfied is the debt with lowell which is the debt bryan carter is sending the letter in reference to.
    Yes i took it out online.
    Whats a cca letter? Sorry for sounding dumb ive just never had anything like this before
  • A copy of your credit agreement.

    You need to write to them asking for a copy of the agreement as entitled under the consumer credit act. Send them a postal order or cheque for £1.

    Some companies once a debt has been sold on wash there hands of the debt so will report it to your credit file as settled when all that they have done is passed it on.

    Your credit file will show a debt as settled sometimes if your original creditor has sold the debt on. Then one pops up from the debt collection agency

    So today i recieved a claim form which i have 14 days to respond to, or 28 if i request, even though i have recieved this can i still send a letter requesting a cca?

    Yes you can still request the cca as the debt collector has to produce this in the county court to prove you do owe the funds.

    Acknowledge service and give yourself 28 days to see if you can chance a defence. And get your cca request in fast. Some catalogue companies were lax on credit agreements till about 2006 so there's a possibility of a s127(3) defence.

    If it's Northampton Court, you can (and should) acknowledge service online.
