Wrote my letter, offered 100 upfront upon confirmation that they accept my proposal, plus 200 a month starting 17th feb, with last payment of 125.41 due on April 17th.
I can't say fairer than that can I! That's very quick to clear it0 -

Hi,
Do capquest actually own this debt, or was it assigned to them ?
Point to make, only the creditor who owns the debt can take you to court, a DCA can shout an ball all it likes but unless they actually own the debt they cant do a thing to you.
You need to get clarification on its status, as advised above, write asking for proof that you owe this debt, proof they have a legal right to demand payment from you, whether the debt is owned outright or has been assigned, copy of any notice of assignment, copy of any deed of novation. If they cant provide proof, you do not have to pay them, and they cant get a CCJ against you, most DCA`s are chancers and cant provide any proof, don't be took in by there threats they are mostly hot air.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. You have sent them proven it letters to see if they hold any paper work to collect the account.
Usually they don't.Be happy...;)0 -
Send them a CCA request.
No signed original, no CCJ when you defend it.
I would do this and save yourself some money. The chances of them having the necessary paperwork are likely to be close to zero.:beer:0
