Dismissal during probation

I have been dismissed at the end of my probation period. I was not given a job description, training or guidance regarding my role, which was newly created.

There is no discrimination on grounds of race, gender or sexuality so I am concerned they are entitled to simply call me in at the end of the probation period and sack me. They told me I was not suitable for the role and gave me a month's notice. Then they sent me home. I'm sure I would have been more suited to the role if the company had shown me the ropes or actually given me work to do.

Is there any legal recourse?

    I am sorry to hear that they have finished you at the end of your probationary period. Unfortunately, that's what lots of companies do as there is no recourse within first 2 years of employment unless there are equality discrimination issues.

    Pick yourself up, dust yourself down and next time ask questions in your probationary period, ask for training etc and put it down to experience! It might even be a blessing in disguise.

    Although there is no real legal route you can go down, due to it not being unfair dismissal. Also not wrongful dismissal as your employer appears to have followed the correct procedure. (I'm presuming this probationary period was in line with you contract).

    The only thing I would suggest would be to either appeal the decision(this ma have been given as an option after your dismissal). Outlining your lack of training received and why you believe the decision was unfair.

    Yes its a shame you have been let go, you could try what has been suggested above but could you really see yourself back there or do you want start afresh. Did they dismiss you or just let you go as it wasn't working ?

    I know what it feels like to receive little or no training.

    Do you think there is a difference between "dismissal" and "being let go"?

    "Being let go" is a mealy mouthed way of saying someone was dismissed.

    Being dismissed does not mean that the person has done anything wrong. For instance, people leaving an organisation because of redundancy are being dismissed.

    Woah take it easy. Ive always associated dismissed when you have had so many warnings and are fired and being let go when your made redundant but hey Ive never thought there was a difference until you pointed it out.

    There is no legal recourse but I'd email the manager that did the hiring and tell them what a lot of money they have just wasted by recruiting for a role and paying someone to do it for several months without giving that person any training or even describing what they were supposed to be doing!

    What did the job description say you were to be doing?

    Seems rather off to me to recruit someone, offer no training and get rid of them again without actually giving them a chance to fulfil a role properly as they didn't even have the brains to write down what they needed.

    Be glad you're out of there as they sound like complete morons to work for.

    Absolutely.

    Maybe you could come to some 'agreement' with the company as your next employer may ask why you left your previous position and having to state you were 'let go' after your probationary period may reflect badly - irrespective of the reasons.
  • What genre of work was it? Sales?

    If so, poor performance would be cited if you didn't sell enough.

    No recourse for your hurt i'm afraid but the best thing you can do is learn from it and move on.
