Resigning after 6 months longterm sickness

Hi,

Have been on longterm sick from work due to a major op/complications. Have decided to resign from the role for a number of reasons.

It has only just occurred to me that when I resign, I should be entitled to receive accrued holiday pay as I didnt take any holidays whilst being off sick (I was paid 28 weeks SSP).

Does anyone know if accrued bank holiday pay is also paid when I resign?

    statutory holidays 5.6 weeks pro-rata.

    In many cases the notice period should be paid as well.(employment act)

    usually it is best to just carry on and not resign

    Notice pay isn't paid if the OP resigns. That only applies if they are dismissed and also meet the qualifying criteria. There is also some confusion in the law about the amount of accrued holiday that has to be paid - it isn't the UK statutory amount. I can't quite recall the details I read, but I believe that only 4 weeks per year is the legal requirement. Happy to be told otherwise, but it was a lawyer I read saying this.
