Hi Guys, I've worked for my company for 18 months, The probationary period was 3 months, But the probationary meeting never got organised until 6 months. The date my meeting was on, I was on holiday and when I got back nothing was ever said about it again. I've been wanting to leave for nearly a year so I've never brought my contract up as I still believe I'm on a temporary one. I haven't signed any contract or even seen a permanent one.
My contract says
" During the probationary period, notice will be 1 week from either you or the company unless specifically stated otherwise in your Principal Statement of Terms and Conditions. The company reserves the right to extend your probationary period in necessary. Following the satisfactory completion of your probationary period, the period of notice to be given by either side is as follows unless specifically start otherwise in your Principal Statement "
Up to 4 years - 4 weeks notice.
"Following the successful completion of your probationary period the notice to be given to you to terminate your employment is four weeks.
During your probationary period the amount will be one week"
If I'm right in saying even though I've worked there 18 months I am still technically on a temporary contract and can give 1 weeks notice when it comes to moving jobs?.
I really want to get out of this company fast and I know they will put up a fight with 1 weeks notice period, I'm just wondering if there is any acts/ laws which can help me out.

Sadly, by continuing to work past your probationary period you have accepted the T&C's and so I would guess that your notice period is now 4 weeks.
If you leave the company and only give 1 weeks notice what can happen to you ..... well you are legally only responsible for any additional costs that your employer faces as a result of you leaving but to get this money they would have to take you to the Small Claims Court. As an example, if you get paid £500 per week and they have to bring in a temp for 3 weeks at £600 then you will technically be liable for £300.:jI am an Employment Law Paralegal and an experienced Human Resources Manager and offer my guidance as simply that ... guidance :j0 -

What does the contract say about the probation period and successful completion.
How is it measured or determined will it be in writing etc.
it is not a temporary contract.
The key is at some point there is a specified change in term if certain criteria are met specifically notice periods.
Have those criteria been met?0 -
