Mis sold personal loan agreement

We had a hire purchase with Pegoet finance and returned the car back to them a few weeks ago as in the financial agreement it stated if halfway through the vehicle could be returned as long as in good working condition and all payments up to date. It is in good working condition and mot'd etc.
Someone picked it up last week. Yesterday we got a letter from RMS Receivables states that that condition was more than wear and tears. There were a couple scruffs but some of the stuff they claimed ie dents on roof etc - which never new it had. Have billed as for just over £1600 pounds to be paid immediately. None of this was mentioned previously. Is this normal practice. Also we dont have that much money to pay all at once. What are our options. Please help.

So did the car have a dent in the roof when you returned it? If it did, then that's not fair wear and tear and you are liable. If it didn't, then you'll have to prove it didn't when you returned the vehicle.
Did you take any photographs before you returned it?

They were no dents. Cars never been in an accident. That is one of the bigger things that they are charging for plus alot other minor stuff. Only couple minor scratches which i know were there. The rest I dont know where they got from. Unfortunately never took pictures. Even from the pictures they have sent I cant see any dents in the roof.0

Can you go and see the car now?
If you don't have pics of how it was when you returned it, it might be hard, but at least worth going to see whether the dents actually exist, surely?
Did the person that collected it not go round the car with you, to check for damage etc?From £8,800 to £2,200 in 2 years.

The company we got billed from is not Peugeot finance. The company who are demanding the money is called rms receivables based in Leeds.0

Might be a good idea to check their T&C's. Logic would suggest in situations such as this, surely the car would be assessed when you return it, and an agreement signed by yourself and the member of staff assessing it to confirm any damages are accepted. Doesn't seem like a fair way to trade just billing you afterwards, as there is then no proof of when the damage occurred. I would recommend speaking with the CAB.0

I was interested to read this as it was one of the top things that came up in a google search for "RMS Receivables". Conveniently, the web address they have provided on their correspondence doesn't even seem to be registered and there is no email address available to contact them. Just wondered if you managed to sort this please as we have had a similar situation, returned an 08 plate car in good condition and have recieved a bill for "damage above wear and tear" (which is nonsense!) Any advice would be gratefully received, many thanks!0 -

When returning any car an inspection should take place to record it's condition - in the same way you would with a hire car. If you did not ask that this was done at the point you returned it (or at least took your own photos) then you have no evidence as to what condition the car was in when you returned it. At the very least there will be a clause as to the expected condition of the car when retuned. How can this be established without inspection? As you have no record of the condition of the car you may have a fight on your hands to prove that the damage they claim is false. I hope you manage to get it sorted.0 -

I had a PCP deal with Citroen which I terminated early in September 2013 and I'm having the same problem with RMS Receivables.
Right from the starting point when an operative came to collect the vehicle I have had a strong impression that this company are a bunch of sharks.
The operative wanted me to sign the car over to him before he had even carried out an inspection which I found suspicious. I refused so he carried on, didn't mention any defects and then when he had finished, got me to sign his electronic notepad to hand the vehicle over and was then about drive off before giving me any written acknowledgement of receipt of the vehicle. When I asked for this, he grudgingly produced a printout and then drove off before I had a chance to read it.
The report mentioned a 'golf-ball' size dent in the door which I had never seen in my life and some scratching to the alloy wheels.
I subsequently received a bill for over £2500 based on the 'poor condition' of the car. The thing is, the car was actually in very good condition.
I'm refusing to pay. The whole thing stinks and I'm shocked that car manufacturers would allow their customers to be handed over to a company like this who at best seem very unethical and at worst, downright crooks.0 -

That's shocking! Yes I believe they are utter con artists, conveniently when I entered their website (as stated on their letter headed paper) it appears the domain isn't even registered! Defo dodgy if you ask me! How are you getting on? We have written a letter of complaint to RMS, Peugeot, Peugeot finance and the garage we had the car from (as our issue is that some of the "damage" they are claiming was there when we purchased the car second-hand). We have yet to hear back from anyone, keep us posted and hopefully we can stop these con-men! Good luck!0
