Redundancy whilst in IPA

Hi
I have had confirmation from Debtline that the OR cannot touch your redundancy payout after you are discharged. Can anyone tell me if it matters if you are made voluntary or compulsory redundant, can the OR intervene at all, as I am still wary. For example if you take voluntary redundancy can the OR say that it was your decision so therefore could take the money. I may just ring the insolvency service anonomously to fine out for sure.
I am rambling here a little and this may not make too much sense but hope one of you out there can respond.
Thanks

Don't quote me, but I don't think it matters. Only the legal status of the payments matter.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Hi lala
If your last day of employment was after discharge, the redundancy payment cannot be claimed by the OR.
The relevant sections of the Insolvency Service manual are:
31.5.32 - 31.5.35 http://www.insolvencydirect.bis.gov.uk/technicalmanual/Ch25-36/Chapter31/part5/part2/part_2.htm
and
30.116 http://www.insolvencydirect.bis.gov.uk/freedomofinformation/technical/TechnicalManual/Ch25-36/Chapter30/Part%205/Part%205.htm

Wow thank you Dennis, that's really helpful. I am so scared of phoning them to tell them, even though you have provided that it black and white I worry that because it is such a large amount ie 30k+ that they will still want a cut. I am guessing when I do finally pluck up the courage to tell them my IPA will cease until I find alternative employment.0 -
Hi lala,
Please let us know how you get on. I will be in a similar position by April, but was told there is a possibility your redundancy money could be taken to cover what would have been your future IPA payments, even if discharged. I have already ensured I have another job to go to, so would be continuing to pay, (albeit slightly lower). It would be good to know what your experience was.
All the best,

Sorry HSE, just noticed your response, not been on for a while. I am still awaiting confirmation of redundancy, but a month ago I contacted the money advice people, their name escapes me. They advised me they cannot take your redundancy compensation if you have been discharged but can if you are still an undischarged bankrupt. It is compensation afterall and not earnings. They sent me some paperwork to back up this statement from the technical manual the IS use. Hope this helps.0
