They are asking me to sign a "Variation of Contract Form", which I have declined as it stated the incorrect entitlement.0

I agree that you ARE entitled to the full amount.
Full-time employees are entitled to 5.6 weeks’ paid holiday each year. This means that full-time employees are entitled to at least 28 days’ paid leave each year.
Part-time employees, temporary staff and casual workers are entitled to paid holidays on a pro-rata basis. If full-time workers get more than the statutory entitlement, then part-timers and other workers are also entitled to the same amount of holiday leave also calculated on a pro-rata basis.
There is a holiday entitlement calculator on the GOV.UK website to help you work out entitlements.
The options are:
Round days up (but not down).
Carry days forward (but everyone must take at least four weeks in the leave year).
Devise a system for late starting or early finishing to get the part-days out of the way.
But, like others have said is it really worth rocking the apple cart over 0.2 of a day? If it is then submit a Grievance to HR and they will have to hear your argument and then make a ruling. If you are still not happy you can then appeal this to a more senior person.:jI am an Employment Law Paralegal and an experienced Human Resources Manager and offer my guidance as simply that ... guidance :j0 -
For me, its a matter of principle. To me x.2 days holidays doesn't amount to much but when I think how many staff in our company are part-timers then this is quite a bit of money the company is trying to save.
.
But the company also round up so they're not really saving anything. You may lose out but others gain.
You're going to force the company to introduce a system that annoys everyone who has their days rounded up!
I imagine you'll be very popular in the office with your co workers!
Frankly it's all a bit pathetic. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -

Agreed. For a 7.5 hour day 0.2 is 1.5hours a Year. Do they allow paid time off for gp/dentist? I'd suggest pick your battles0 -
Hello all,
I work part time my holidays are pro-rated. However, my company have rounded my entitlement down from 27.2 to 27. Now I know they are not allowed to do that. I am trying to find which section in the working time directive section this would be related to. I have already shown them ACAS information regarding this but they consider company guidelines supersedes the law and also the holiday entitlement calculator which says below that they cannot round down. Their answer to my query was that "the rounding has always been done this way" and that they "are giving me at least the statutory minimum leave in line with ACAS guidelines." and "therefore they are unable to change my rounding".
Furthermore, I know that staff whose holiday entitlements were calculated and came to 26.4 would then be rounded up to 26.5.
Would really appreciate your help.
Thanks Antje0
