    Why did the child benefit stop? Your marital status is not relevant - what is relevant is the type of educational course your daughter is following. If she's in full time, non advanced education I suggest you contact child benefit centre as a matter of urgency to get the child benefit reinstated. If you fail with this course if action then I'm afraid your ex partner will be entitled to a refund.

    How old is your daughter? It may be worth phoning child benefit to see whether they class the course as non-advanced.
  • This link: http://ofqual.gov.uk/help-and-advice/comparing-qualifications/ confirms that a HND is classed as higher education, so it is right that both child benefit and child support should have ended when she commenced the course.
    I often use a tablet to post, so sometimes my posts will have random letters inserted, or entirely the wrong word if autocorrect is trying to wind me up. Hopefully you'll still know what I mean.

    Higher National Diploma which is the first two years of a degree so it is highter education and you were not eligible for CSA.

    I hope that she understands this and has not applied to start another degree in the first year, as she will only get residual funding from the SFE (assuming England).

    My neighbour has just had this issue with the CSA. Her daughter is at college and her Child Benefit stopped last year. I told her I had read that maintenance stops when child benefit stops but she was adamant she was in the right.

    She has to repay 3,600 to her ex and is struggling but it being taken direct from her wages each month.

    Whilst I have sympathy to a degree it works both ways, if the NRP dosnt make the payments then we expect them to be chased so when they have made overpayments then its only right they are refunded.
  • The CSA works in mysterious ways,we are still waiting patiently for the decision on our case about pwc fraudulently claiming child benefit.

    I believe she would have been elligible for grants/loans to support herself. It's a real pity that all this wasn't investigated at the time.
