Do they mean that they are protected from being eaten by the Queen, or that the Queen protects them from being eaten (by someone else)

I take it to mean "Is the queen allowed to eat swans?". I think she is allowed to eat swans as all swans belong to the Queen. No-one except the queen is allowed to eat swans.

Therefore swans are not protected from being eaten by the queen

An artist has risked the wrath of monarchists - not to mention breaking the law by eating swan - a privilege only legally available to the Queen.
