Handing keys back to shared ownership house

Hello, I do hope someone can help me.
I am a discharged bankrupt .. April 2013.
I have a shared ownership property that I no longer live in as I moved away due to rising costs and redundancy etc.. I now rent somewhere else a long long way away.
I have not paid any mortgage on my property since July 2013. I have been upfront all the way with both my mortgage company (Halifax) and my housing association. I last paid rent on the 50% share in November.
I am paying the council tax on both properties at present, reduced on my shared ownership house as I do not live there until the Halifax repo it.
I keep getting letters saying they are going to go down the legal action route but nothing as yet.
I now have a problem as the housing association are chasing me for the rent portion. I advised them of my actions in that I have left my property and my housing officer was aware of this fact but I had rather hoped that the repo would have happened by now. Now I have a bill from the HA of 350 and this will be ongoing I guess until repossession. I do not know what to do or what direction to go in.. I cannot afford 2 lots of rent..
I have emailed the housing association today but do not expect a response back just yet.. stumped...:(
Any help or advice appreciated.

  • I was I a very similar situation before bankruptcy. Stepchange told me non payment of mortgage and repossession action can take a year in some cases. Have you asked Halifax about voluntary surrender where you hand keys back as opposed to letting them go down the repossession through court route? Long story short I did this, handed keys back and they had it up for sale within a month and my share ended up being bought back by the housing association within 2. They were aware of my situation and never offered to buy my share back when I told them though.

    You will only mount up more arrears otherwise.
  • Thank you so much for replying. I think you are right. I did intend to hand the keys back originally but thought the Halifax may repossess quicker than this. Cannot believe how slow it is.

    I have had a call today from the Halifax's solicitors asking me to call. Not sure if I should though.. :(

  • Well, decision taken away now.. just had a repossession notice in the post re hearing end of feb.. so I am going to hold fire and let it go it's natural course.

    Do I have to attend the hearing if I intend to let the repossession go ahead?? Any advice would be very much appreciated please?
