    Write to them and tell them that as they can't find info on your account they are required to remove all derogatory information as they cannot prove it is correct. Refer to FOS and ICO if they refuse.

  • Update on this and more advice needed :-)

    I am still paying £15 a month, the debt outstanding is about £1500.

    I raised a case with Equifax, querying the '6 Payments Late' flag and showed them a few emails I had sent to the company I have the debt with, they contacted the company, after a number of days as the company had not responded to them I requested their entry to be removed from my file.

    As I knew this would come back and be an issues again at any time I also raised a case with the FSO.

    After a very long investigation, they have got back to me and advised it is more appropriate to replace the '6 Payments Late' flag with an ‘arrangement to repay’ marker.

    I challenged this, advised that I believed I should have had a default many years ago (2003), all the stress this caused me over the years and refusal of loan consolidation due to to the 6 Payments late flag, I also said that if I had of had the default back then, even if I still owed money now the file would have been removed after 6 years (I think this is right)

    They have come back with the following:

    This service can only look at the complaint from 2007 onwards as before this we did not have the jurisdiction to investigate complaint against *.

    I have considered your complaint from 2007 onwards only. Even if a default notice had been served all those years ago, * would still report the arrears on your credit file. It can continue to do so if there is an outstanding balance even after six years has expired and the default has fallen off your credit file.

    I am happy to put your case in the queue for an Ombudsman decision. But I would like to know exactly what resolution you are looking for. As I have explained before an arrangement to repay marker is what * is entitled to now report on your credit file.


    Has anyone got any advise on where I stand now?

    That is complete nonsense.

    Once the default drops off so does all trace of the account and nothing more can be recorded on your credit file, ever. No status or late payments, defaults, arrears. Nothing at all.

    I will let them know that I am not happy with the decision and will only be happy when a retrospective default is added.

    If they only have jurisdiction from 2007 onwards they could enforce the retrospective default for then and it would still be off my credit file now.

    I will ask them to pass the case onto the Ombudsman for final review.
