Ex partner, bankruptcy, house. Need advice pls!

Hi.
Try to keep this short.
Property still in joint names, as is mortgage. Ex discharged bankrupt.

Can I:
A). Get him removed from deeds via court and then sell property
B) Sign over mortgage to him, but unsure on deeds part
C). Just go to court and let them decide?

Would the bankruptcy remain or does it get removed? Will the building society agree to me removing myself from mortgage (ex is a long term bad payer :-( and he would have to be credit cleared to take over mortgage)

House is a shared ownership property, so not talking vast profits, if any.

Can't take stress of his arrears and the phone calls about them, also trying to move house myself, but being classed as a 'bad payer' because of him.

Divorced in 1995, not lived in property since 2001.

Any advice greatly appreciated. Thanks!

    Timeline here? Who went bankrupt and when? Was the current mortgage in place when you/they did, and no re-mortgage/new secured loan since?

  • Ok, ex was made bankrupt in 1992/3? When we were still marries and mortgage was obtained in 1987, also whilst we were married. House was re-mortgaged in 2011, fraudulently at first then I was rail roadbed into agreeing some 6 months later, but that's a different story...

  • Do you have any mortgage arrears?
  • On the property there has been up to £8k (in 2007) and about £150 atm.
    When ex left property in 1995, about £2k, when I left in 2001, about £1k.

    I think the cheapest option (for you) would be to persuade ex to sell the property and repay the mortgage that way. Anything that involves getting a court to decide would be expensive.

    Bearing in mind the previous fraud, I suspect an amicable settlement might be difficult - and so you might well need a solicitor to sort this out.

    Were you ever married to your ex? Even if not, did you reach an agreement when you left about what would happen to the house?
