Redwood trying to add £2000+ onto a debt that has nearly been paid off

Hi Im wondering if someone can help me out with an ongoing matter regarding a funeral debt.

My Granddad passed away back in 2006, my mum is the eldest of 6 sisters so she basically took on the funeral debt in her name. She struggled to pay it off on her own (sisters didnt help), and kept quiet about for years until debt collectors got involved (Redwood).

The funeral bill was for £4100, the debt collector eventually sent her a statutory demand for £4500+ (the original £4100 plus their collection fees). She offered to pay them £300 a month and made several offers which were all turned down, they then took her to court to try and and make her bankrupt.

Before she went to court she managed to bring it down from £4100 to £3250.

So she went to court still owing £3250 on the debt. Fortunately the judge took into consideration my mum had made offers and wasnt receiving help from her sisters. He laid out some terms that my mum pay £275 a month.

A few days later she received a letter from the court outlining the terms stating the £275 a month and the amount owing £3371.

Since then my mum has managed to pay £3060 since going to court last April, which means if she pays £311 at the end of this month she'll have paid the £3371 outlined in the letter from the court, her case is due to be reviewed on the 4th Feb.

Theres a few things id like to ask.
  • Firstly does anyone know why the court will have asked for £3371 when at the time of going to court she owed around £3250? thats an extra £121? Court fees maybe?

  • Secondly the statutory demand said they were asking for £4500+ But the court asked for £3371, ive told my mum to ignore the statutory demand and to not pay the extra as the court have only asked for £3371, is it safe to assume that?

  • My mum asked Redwood in November what her balance was, she was shocked when they said she still owed £3800+ !?? As i said earlier at the end of this month shell have paid off what the court said to pay off. Now suddenly Redwood are claiming she still owes an extra £2000+ in court, solicitor and collection fees!!?? My mum has asked over the phone for an itemised bill of where this mystery sum of £2000+ has come from and they havent sent anything! Ive told her to ask about it in court next month. Can anyone give us some advice on this please?

    The £121 is likely court fees.

    Does the court judgement allow the creditor to continue to add interest to the debt? The judgement should say if it does and that could explain the increase in the debt.

    I would suggest mother writes to creditor and asks details of the outstanding balance and a full transaction breakdown.
