Bank error in my favour - what am I entitled to

Hi, Rob from Manchester here:

In February a large amount of cash was taken from my account by LloydsTSB without my knowledge. This was for a cheque that had been lost by the bank in the system and about a month after the cheque had cleared they took the money without any communications to me at any point. I will not bore you with the details and as you are no doubt aware it is now nearly July and I have pushed and shoved my way with this one and got them to return it because of the lack of communication and the behaviour of their staff in this matter (with great thanks to one very very helpful member of staff at my branch). The charges are supposed to being returned along with the full amount of the cheque.

Now this is all well and good but is no more than I am entitled to, so what am I entitled to for the days I have spent arguing the toss with the 'ever so helpful' collections department, calls to the helpline, my branch, temporarily ceasing direct debits and paying by card. I was sure I read that I was entitled to reasonable compensation for my time and inconvenience as well as any charges that this incurred. Could anyone clarify?

    You are not entitled to anything other than being returned to the position you were in before the error.

    Anything above that is at the discretion of the bank.

    I am not clear whether this was a cheque which you deposited into your account, appeared to clear and was then withdrawn from your account, or a cheque which you wrote which didn't clear out of your account until months after your wrote it.

    Could you perhaps clarify that?
  • It was a cheque I paid into my account from another party, I have still received no satisfactory explanation. I thought I was entitled to some sort of compensation for my time etc

    So has the cheque bounced? Cheques can bounce long after they appear to be cleared.

    I don't think the bank has to compensate you for your time, even if this has been caused by an error.
