I've taken a whistleblowing case to ET funded by an insurance policy.
During case preparation my barrister initially thought whistleblowing claim only had low chance of success, contrary to my solicitor who thought it had more than 50%. I persuaded my barrister to change their mind.
But, and this is a huge but, my normal unfair dismissal claim never had any doubt about its success.
As you don't want to discuss the case in detail here, fully understandable, PM me if you want the details of how I proceeded to take it to ET.0 -
If you take on the case and lose, it's not just benefits they will be looking at, it will also be any assets you have to cover the costs, including any equity in your home. Like you've been told, it seems you don't have much of case but if you keep pushing for compensation, it could get a whole lot more expensive.
This is why I agree to a large extent to the recent tribunal reforms where one has to provide a surety to start proceedings. This weeds out the opportunist and frivolous cases against employers.
Sadly through these reforms it seems fortification of power goes to employers.
Sometimes it's better to put it down to experience and move on.0
