Tax Rebate - crack in the system?

Hi there! im new to the forum
!
So i believe i've fallen into a small crack in the system in regards to tax.
iv been trying to claim my tax back for 18 months now with no results, im claiming for the period oct 12 to april 13 i should have had a tax rebate as the total i earned is near about my personal allowance amount for that tax year.
Although it turns out my work only put me on the paye role in april13 and for the rest of the 5 months i was working full time on a PAYE supposedly i was actually being paid cash in hand into my bank account with the tax being deducted, although the tax office has no record of the tax being paid expect for the 6th month (april 13) which HM renvenues have paid me back for now. So after i told my boss and he basically did nothing for a year hes finally given me the accountant and American accountant? details to contact so bacially leaving me to sort it out so ic contacted the accountant and this women that seems like the highier level accountant in america (through email takes about a week to reply) and the tax office, trying to sort this out and basically no one can help me just a triangle of back and forth:
The tax office just didn't care there response was "well if we dont have the tax money how can pay you it" which is fair enough but the lack of advice and power i have as an employee is crap frankly.

So we estimated your tax and deducted that – That year, you should have filed a self assessment return. (this is bull, WHY? i was on the paye or meant to be)
So for now this is what I propose: explain the situation to Blah(english accountant), tell her you need to fill in a self assessment for that period – There will probably be some late filing fee, but don’t worry just let me know what it is and I will reimburse you.
There will be money owed to the tax office – Whatever you owe, let me know and we will make the payment for it, because in fact what you owe is what was deducted at the time.
Hope this makes sense!! If not please don’t hesitate to come back to me for clarification."
So basically to me they want to put it all on me, i spoke to the tax office asked about filling a self assessment and she said you wont get the tax back and could possible end up paying money out.
Im absolutely furious at how little control i have over this and the fact that im owed about £800 in tax which i could miss out on.
So is there anything i can do? or any advice anyone could give me? sorry about the long message!

First off, why do you think you are owed a tax rebate? We're you actually paying tax to the taxman and not earning £9440 in the tax year?Be Alert..........Britain needs lerts.0

First may I suggest that you try this on the cutting tax forum if possible with a smaller and less bold font.
Second not a solution but I think that your employer needs to re-think their solution. As I understand it your earnings for this tax year are just about the level at which tax would be paid so if you do a self assessment there will be little or no tax to be paid so there will be little or nothing for your employer to repay to you.
A possible solution might be for the employer to advise exactly what was deducted from the wage you received and pays that to you so you now have the the full gross pay. You can declare this to HMRC and pay any tax due from their payment to you and any fines for late declaration your employer can pay as they have promised.
As I said try the tax forum for other suggestions this is all I can think of and it does not account for NI, perhaps best not bothered with if you can get the full deductions back.0 -

I'm owed the tax this is how i understand it because I've never worked fulltime before, and basically because I started late in the tax year the total tax pay for the year has already been ducted although I'm allowed a personal allowance of 8105 for that year 2012 so adding my wage for those months there about is on par with the personal allowance which means I can claim the tax back that's been ducted, I think that's the cas e I find it so hard to explain these things, iv spoke to hm revenues and they've confirmed that I'm eligable for a tax rebate and the full chunkthanks again guys I'll repost

Aren't the self assessment forms for tax year ending in 2013 due before January 31st? If you do it online it is. So if you do go down that route make sure you do it before then so there are no late fees.0

apprently i have 4 years says the tax office to sort this out, the problem was the in the tax year 2012 to 2013. just tried the citizens advice line and its closed.

If the tax deduction hasn't been paid to the taxman and you earned less than your allowance then your claim for rebate is against your employer as its they who stopped the cash and never forwarded it to HMRC.Be Alert..........Britain needs lerts.0
