Overpaid wages

Apologies if this is in the wrong section.

I have handed my 1 week notice in at work, and I am due to leave. Because of how the pay dates have fallen etc, it has emerged that I owe my employer 2 weeks of wages.

I will of course pay back what I owe, but my question is, can my employer simply remove the money from my bank account? I was of the impression I would physically have to transfer the money back to my employer, but someone mentioned that they can simply apply to retrieve it from my account.

As I mentioned, I am 100% required to pay back what I owe - I know this - but I am just wondering if what my colleague said is correct.

No they can not take it from your back if you have been paid

What period have you been paid for and when is your last day?

They should issue you with a - pay slip detailing the gross, tax and NI all as negative figures and that's the amount you will owe them.

Also do they owe you any holiday pay?

    Thank you for your reply.

Basically, the way our payday works is we are paid 2 weeks in advance (i.e paid for the 2 weeks we already worked, and the 2 forthcoming weeks). Our payday is on 15th of each month.

I handed my notice in on our pay date, and I am required to give 1 week of notice. Therefore, when I leave, I will effectively owe them 1 week of pay.

I believe that I should be owed 2 days of holiday, but my employer is insistent that I don't. So, as it stands, I am due to leave at the end of next week and I will be due to owe them 1 weeks worth of salary.

(To clarify, I said in my original post I will owe 2 weeks but I have mixed my dates etc up. So I will in fact owe them 1 week as mentioned in this post!!)

they cannot dip into your account - but as you have just been paid, it is simply a matter of putting that money aside and repaying them.
