Help - in meltdown re bank account...

I am going BR tomorrow, end of the line. I am due payment of JSA and HB on Monday into an overdrawn current account (that is not at the limit). If it take these payments out today to put into a new account next week as I wont be able to touch the other account on Monday, will that be OK? I absolutely need that money - it would be 431.86 - Please can someone help me??

Contact the JSA and HB people and get them to make your payments into a different bank account. I dont know how long it will take to redirect the payments.
If you could close your OD account today, then your JSA and HB payments would bounce back and then be placed in your alternative bank account when the payments are set up. But you may not be able to close your OD account because it has an outstanding OD.
I dont think you can withdraw that money now from your account with the OD because youd then be purposely increasing your overdraft debt prior to bankruptcy.
Contact the JSA and HB people today.
Or you could postpone your BR for a week or two until your JSA and HB payments have been redirected to your different account.0 -

Hi thanks for this> I called StepChange and they said that they didn't think the OR could touch that money as it's benefits, and therefore think I should still be able to get it out on Monday. But recommended I call the insolvency service which I've just done. They advised that it is up to the bank to decide if they keep me as a customer, and up to them if they will let me draw that money out on Monday...He said I should go in today and speak to them (HSBC) and ask them if they will keep me if I go bankrupt. I said wont they stop the account there and then if I say that he said no, because you aren't BR yet.
I really do need to do this tomorrow so will contact DWP and housing ben to get them to hold payment until I get them new account details...

Dont tip off HSBC about your BR for tomorrow just yet as you dont want them locking your account.
If the IS have said you can access your benefits, then get them out on Monday sharpish! It will take a while before the OR gets around to contacting HSBC to let them know about your BR if it goes through tomorrow.

HSBC told me they always close banks acc down for br. I closed mine before and got my co op account up and running a month before I went br...better to be prepared0

Hi All and thank you for your contributions.
I went to Barclays this afternoon, met the nicest man possible, told him I was going BR tomorrow, he opened me up an account there and then, and applied for transfer of DD's and SO's from HSBC. Even though I owe Barclaycard quite a lot, he was still very happy to open the account.
As soon as I had the account number and sort code I went to the town hall to get them to stop paying the HB into the old account - it was too late but they have applied to claw it back and will send it to my new account (I have to provide them with last three bank statements so that they can see I have been paying the rent, which I have). They also couldn't have been nicer or more helpful. Then I phoned the DWP who had also just paid my JSA, but again, they are trying to claw it back and will repay into new account. Again, they couldn't have been more helpful.
So, hopefully I'll get that money stopped. If not, I'll phone the Insolvency people on Monday and ask again - he was the least helpful person I spoke to today.
So, I've done all I can. I've got my original unsigned forms and two copies, most recent of all bank / credit card statements etc and am ready for tomorrow morning when I go to court.
I guess my next biggest fear is that being on JSA and HB, there's not enough income to pay the rent and essentials. I had a 2nd interview this morning for a 6 months full time contract at a great company, will hear early next week. It went really well so please all pray for me that I get it :-)
Thank you all again, I feel ready for tomorrow, know it's absolutely the right and only thing to do, and from tomorrow, I can start to rebuild my rather shattered life.0 -

Hi All,
thought the conclusion of my experience yesterday with bank account and getting HB and JSA stopped and repaid:
HB trying and will keep me posted, DWP managed to stop it and are paying it today into new account. I am stunned by the prompt action and excellent customer service from both the Town Hall and DWP. I can't believe how helpful everyone has been - out of adversity I have discovered that there are many wonderful and caring people out there, which is fantastic!
So onwards and upwards - if you are in a similar position and freaking out, people will help you0
