Employer Claiming for money on contract they never paid for.

    is it stamped ? it should have a court seal stamped on the form itself where it says seal has it come from Money claim on-line ?

  • Yeah it's stamped, although it came from Northampton which isn't my local CC

    Does it give log in details for the online site and if so you should log in and select defend whole claim which buys 28 days time to get a defence ready.

    You MUST ONLY deal with the court now or you WILL get a CCJ against you for that amount.

    Then you have until the end of the week to get your defense into the Court (and a copy to your opponents).

    You could try -

    In my defense, I submit that on [insert date of course], I attended a course entitled [name of course]. This course was won in an industry-wide competition.
    As the course cost myself & my employer nothing, I believe that, even though I was forced to sign a contract prior to being given permission to attend the course, that the charge of £2000 is in fact a contractual penalty which is unenforceable in law as per case law Dunlop Pneumatic Tyre Company v New Garage & Motor co [1915] AC 79.
    Never Knowingly Understood.

  • The contract is only about 5 lines long, just just says that if my employment ends before sept 2014 that I have to repay them for the cost of the training to the sum of £2000 plus vat
