P45 received, but haven't quit

Can an employer do this??

I'm confused on why they have without my notice.

However I know why they have, they have assumed I no longer want to work in the school holidays (this is when I did work as it is a school holiday club and I work in a school) as I recently became a mum.

To be honest I hadn't given it any thought to handing my notice in. It's just something I hadn't got round to thinking about. We're not contracted to a set amount of hours, we just let them know if we're available when school holidays are approaching.

As I was due my baby in September I let them know after I worked in the Easter holidays that I wouldn't be available to work August.

It was just a bit of a shock to get that kind of post on Saturday.

If I did decide I still wanted that job can I do anything to get it back?

Like I said haven't given it any thought, but obviously now I need too.

    I've been working for them for gosh, at least 5 years.

    Haven't looked at my contract yet.

    Last worked for them in the Easter holidays as no playschemes ran in May 1/2 term.

    Is the club only open Easter and Summer -or also half terms and Christmas ?

    If they've not seen you in nine months and heard nothing about your intentions it's hardly surprising they think you aren't coming back.

    Perhaps the first thing to do is look at your contract and the second thing would be to get in contact with them and ASK for your job back (sorry if I seem to be stating the obvious but every contract is different we aren't going to know what terms you were engaged on)

    It may be a misunderstanding and they will be glad to have you back or they may not need you anymore you won't know til you ask the employer.

  • sounds like you are on a zero hour contract so you can choose whether to work and they can choose whether to let you?

    If so if they refuse to allow you back there is little you can do unless you can prove it was due to being on maternity leave.

    Personally it sounds like miscommunication on both sides so hopefully just talking to them will sort this out

  • It's not like that.

    It relies on lottery funding so the playschemes are actually dictated depending on what funding is available. So basically it's available to run every school holidays if it can.

    Summer it always runs and the playschemes are free for the children to attend.

    It's not like I haven't been in touch with them. I worked at Easter and let them know I couldn't work August straight away with it being the busiest school holidays. Nothing ran in May 1/2 term, Oct 1/2 term or Christmas.

    Yes it is a 0 hour contract, so no holidays or entitlements to maternity leave etc.

    It's not a 'business' like you think. I get along really well with the lady who runs it, she actually sent me a present and card when I had my little girl and then a few weeks ago she text me to say she was going to be a grandma again.

    My little girl is only 3 mths old so that is why I haven't had time to think about whether to stay working for them or not.

    Yes nearing 10 months ago. But summer holidays was the last time any playschemes ran so the last time any employees worked.

    Sorry if it seems like wasting your time asking. I had just assumed P45's were issued once someone quit or was obviously sacked.

    Neither myself or the lady who runs it have bought up the subject. We've not fallen out or anything.

  • You are entitled to holiday pay btw, 12.07% of all hours worked.

    Have you contacted your employer yet?

    Sounds like a lack of communication or some mis-communication somewhere along the line.
