Should he get paid for training at work?

Hi,

My husbands' employer has told him he will be doing a training course one Saturday in February. The employer has said that he will pay for the course, but that my husband won't get paid for the time. It's expected to last all day, which means I won't be able to work that day, so won't be able to earn any money either.

Is this right? I get paid NMW for any training at work and thought it was the same for all employment. I've googled but am struggling to find a definitive answer.

    Why can't the course be arranged for a normal working day?

  • An employer can insist a worker attends a training event on a day off if there is a clause in the worker's written statement or contract of employment which makes attendance compulsory. Depending on the terms of the contract, the worker may be entitled to payment for attendance at the training event or time off in lieu.


    When scheduling training, the employer will need to take into account a worker's rights under the Working Time Regulations, including time off between shifts; the number of hours in a week an employee can be asked to work and the right to weekly time off.

    If there is no clause in the worker's contract that would make attendance compulsory, the employer and employee should try to reach a mutual agreement on the issue. For example, the employer may permit the employee to take time off in lieu to make up for the extra hours worked or they may look at whether there are options for the employee to take the training on another date.

    How long has he worked there and whats the pay, can't be asked to do non paid overtime if it takes the wage below NMW

    what does the contract say about overtime or training?
