Maternity Leave and Term Time Only

Hi, I hope someone will be able to help with this, Someone working in a school as an L.S.A, paid term time only,is starting maternity leave on 2nd July. Obvioulsy this is going to run over several school holidays. Does anyone know the situation with this. Someone has said that she should be able to take her holidays eg. the 6 week summer holiday, before she starts maternity leave. HR at the council have absolutely no idea and haven't even been able to deal with the straight forward stuff on this. Does anyone know anywhere I can find out the rules?

    I do know that you get your holidays when you're on ML or sick leave for less than a year but I don't know how it works if she's planning to take the whole year. ACAS should be able to point her in the right direction.

    Don't know if it would make a difference, but does she normally get paid the same throughout the year?

    Thanks for taking the time to answer. She does get paid same amount each month. Apparently HR at looking into with their lawyers! It would be nice to be in the know with some evidence when they come back, they've made such a mess of it so far you'd think no one had ever been pregnant before!

    when is the baby due?

    she could take leave right up to the date the baby is born, but maternity leave must start then!

    if she is off sick within 4 weeks (i think) of the expected date of confinement then her maternity leave will automatically start.

    Mat leave always starts on a Sunday.

    I will be interested to hear this. I work term time only too and will be on mat leave from Sept-June which encompasses around 7 weeks of school holidays (Xmas, Easter etc), My HR are also useless as they haven't even sent me a copy of the mat leave/pay policy yet and yet I am supposed to give my official notice of due dates etc by the end of the week. The head doesn't seem to think holidays are accrued. If they were I would like to take them at the end, after my mat leave finishes.

    Baby is due in October and i get paid a pro-rata salary in 12 equal installments.

    Holidays are accrued during maternity leave. Whether or not you can take them straight after your maternity leave will depend on your head, but well done on perfect timing!!! If baby arrives on time you might get away with only having to do a week or two at work to be paid continuously through the summer holidays!

    I thought that was one of the things which had changed under the new regs, but don't quote me on that ...

    Could also try the Working Families website, you'd expect them to be well informed!
