I hope somebody may be able to give me some advice re a parking charge notice incurred on 28 September 2013.


The parking charge was issued on a residential estate (ironically where my in-laws live) and I was not the driver of the vehicle.


UKPS (NW) Ltd stuck the PCN to the window of the car.


At the time I ignored the PCN. I was not the driver, therefore (having skimmed the forums) I would wait until the Notice to Keeper.


It seems I hadn't read the forums on here as well as I should, as I have just read some guidance for when the vehicle is on contract hire, which mine is.


I have now received a notice to hirer from my leasing company, which is issued by Parking Collection Services on behalf of UKPS (NW) Ltd. My leasing company has also hit me with an invoice too, which is nice (but another story). I am yet to find out if the leasing co has paid the outstanding debt, I am assuming not, but wanted to seek advice here first.


Prior to noticing the different guidance to hirers, I was going to dismiss the claim from UKPS (NW) Ltd on the following basis.


The Notice to Driver, stuck on the windscreen was issued on 29 September 2013. I understood the Notice to Keeper / Hirer had to be received no later than 56 days after the issuance of the Notice to Driver.


The Notice to Hirer in this case was dated by Parking Collection Services as 04 December 2013 which is well over 56 days from the date of the Notice to Driver. Obviously, by the time the letter was posted and received it would have been one or two days after this date.


I was thinking great, I do not need to pay. I was thinking a letter from me explaining how they have fallen short of schedule 4 of the Protection of Freedoms Act 2012 and a simple goodbye would suffice.


Now I am not sure.


Obviously, if the leasing co paid the fine, I have no choice but to reimburse them (which will be annoying at best).


If they haven't, I do not know the next step to take and any thoughts would be appreciated.

    I think a lot of your assumptions above are incorrect, having seen similar threads on the same or similar subjects

    read the NEWBIES sticky thread near the top of the forum whilst waiting for a detailed reply based on more than just assumptions ;)
  • UKPS (NW) LTD joined the IPC on the 1st October 2013 so arguably you would have been unable to appeal this in time using the appeals system open to you when they were members of the BPA. Equally as the parking charge pre-dates the IPC ;

    UKPS are nasty though - they are operating two companies through their registered company number 07546293 -

    one the car parking side UK Parking Services (North West) Limited:

    They even offer body guarding!

    Both run by the delightful Shaune Ashworth assisted by his wife.

    With regard to the OP - I would just ignore for now unless you receive a solicitors letter (probably be Gladstones) as a LBA.

    Of course in the meantime - why not contact your trading standards regarding the information given. As you have also had direct contact with UKPS and have discovered their other little business you should also be able to file a report regarding their security work on the SIA website.
