IPA not gone out

Hi all,

I'm new on here but just wanted some advice pls.

I declared myself bankrupt in November after I realised my DMP wouldn't be clear for another 15 years and glad i did. However, after having the interview with my OR, she said id have to have an IPA because of my surplus money I'm left with. A few days later, I had a letter from the insolvency service asking me to sign to confirm that I agree the amount that would be taken was £630 and then when my tax code changed to NT, it would be £900. It then said the first payment would be the 3rd Jan. I signed the form and sent it back, have heard nothing from anyone since and no payment has been taken.

I spoke to a friend of mine who went bankrupt some years ago and she said that although she was told initially that she would have to pay money back, ( and had been given an amount ) in reality, they never took any money from her. I'm half hoping thats the case, lol.

The money is in my account at the moment, it's about all that is and I'm treading on eggshells trying to be extra careful not to spend into it but its hard when I've got no telephone/internet banking facilities at the moment to know whats going out. I'm now in a position where I'm wondering what to do... It's a lot of money just sitting there waiting and there's things I could really use it for - i loaned the court and bankruptcy fees from my dad - but I'm worried that they'll then suddenly try and take it. Or what happens if i leave it till Feb and they still haven't taken it?

I haven't signed any other form other than the initial one to say I agreed to the amount, wouldn't I need to have signed a d/d or s/o form for it to be taken from my bank?
I dont really want to contact the OR as she wasn't particularly friendly anyway.

Any suggestions or advice would be appreciated !

  • I've just had a letter from my IP 10 months down the line asking for a cheque for all the monies.

    I'd make extra sure you don't touch it. but also make sure that you have enough money left at the month for your cost of living - if your costs go up you should contact them and let them know.

  • Dont touch it , have you been contacted by the comapny who will be collecting the payment ? in my case I was contacted by clarke wilmott , I have to log in online and make a payment each month to them , they do not take the money automatiically from me. Other Ors will use different agents to collect the money and may have differnet procedures

    As the other posters have said - don't touch it. A 3rd party (Moon Beaver or Clarke Willmott) are the usual) will contact you and will give you details of how to pay. Set up another account to put the cash in if you think you are risking spending it. Contact your OR and ask who the collection agent will be - probably just a bit of a backlog in the admin after the Christmas holidays.
