Very quick but urgent question

I am about to leave my current employment and am owed 5 days in lieu I have asked for confirmation that this will be paid and how my final pay cheque will be made up as this will be issued a week r so after I leave. I have been told that the break down will be provided to me then and I am guessing that they will not pay me for the lieu as you are not allowed to carry it forward despite not being able to take it over Christmas and one day being given to me for working the 27th December.

In short is their any requirement for them to tell me prior to leaving what they will be paying me for as I am assuming it will be far harder for me to deal with once i have left.

In addition to this we do not get overtime and are told that the annual bonus covers this, the bonus is paid in March (no mention of it in my COE) and I have been told that as I will not be an employee then I am not entitled to any payment. I am guessing that there is nothing that I can do about this but just thought would ask in case some kind soul could help me.

    the rule is they have to give you a break down before OR with your pay, so sorry you can't make them do it before if they don't want to.

    A bonus is normally only paid if you work there at the time it is paid, unless your contract says otherwise, or if your contract says the bonus is for some aspect of work, which I doubt it does, so they can choose not to pay you it.

    I have a feeling they don't have to pay you for the lieu days either but not sure.

    Just be glad you're leaving, they sound not too good if they won't even tell you what wage to expect.

    Just what I thought my boss has said to us that we get a bonus to cover extra hours worked he is a good fella but he company is not.

  • As you have presumably done the work to accrue time in lieu then I would have thought that if they didn't pay you then this would count as 'an illegal deduction from wages' which potentially is a tribunal claim. You have done the work, so therefore you are entitled to be paid for it. I am a union rep so have some knowledge in this area. Certainly worth researching and perhaps drawing your soon to be ex-employers attention to that. Good luck ,

    i asked them for clarity on this today and they have not responded so I will contact unite on Monday. I have been there well over 10 years and never had so much as an off the record reprimand.

  • I would also check, especially if its a low paid job that the hours worked as ' unpaid overtime' does not take your hourly rate below minimum wage. If it does you may want to mention it to them.

    Of course you may also want to mention it to HMRC too ��

    lieu time will be purely contractual,

    If the contract says it does not carry over year end or get it paid if not taken by the time you leave then getting it paid will be a problem, taking the time off during notice would be the only chance as long as that was also excluded.
