P45 lost in post???

Hi

Last summer i worked for the first time, I was temp with an agency, i stopped due to term starting again.

They say they sent me a P45, I did not get this, I have all the payslips too, I hadn’t chucked anything out.

They say it was processed and it was sent, it may have been lost in the post.

Where do i go from here? Can I get another P45?

Last summer was my first proper job and I understand I can’t work this summer without having my p45 right?

Any help would be appreciated.

    You won't be able to get another P45 but you can call and ask them to send you a Statement of Earnings for the time you were there which will give you the same information.

    You don't need a P45 to start a new job this year (and it probably wouldn't apply anyway as it would relate to a previous tax year) all you need to do is ask to fill out a P46 when you start your new job.

    This happened to me. P45 and last pay cheque went missing together. I told my employer and they provided me with a new P45 and replacement cheque. No idea what procedures they had to follow to do this, just know they were able to sort this out

    Thank you both for your replies, agency said they can't get a replacment, however hopefully it won't matter and i can begin working without paying tax again next week by completing the P46 (previously mentioned in another post).

    P45s are only valid for a limited period- older than a month and we wouldn't use them.

    But if you are a student surely it's a P38 form that you should complete (I think you just call up HMRC and they send it out, or order online). This would mean your earnings are tax free

    Only if you're only working during university holidays and expect your gross earnings for the tax YEAR to be less than your personal allowance (£5000+ I believe).

    If that applies to you, then getting a P38 would be the way to go.

    I suspect if they provided you with a 'replacement' P45 then they were telling fibs and they never actually sent the original as you can't reissue a P45.

    And the the 'replacement' cheque was just the same!

    P38's also only apply if you are still in full time education after the next 5th April (2008) and I got the impression from your first post that that might not be the case. The figure under which you have to earn is £5225 as well (which would probably be likely if the job was just for the summer)
  • I had this too with a manager that was infamous for not giving P45's to ex-employees as this was her way of getting back at them for leaving etc.
    Apparantly this is not against the law! but speak to the tax office, and they can tell you were to go from there and my be able to send you something out.
