case closed, with overpayment.

My case was closed in May 2013. Due to the parent with care claiming child benefit she was not entitled to, I over paid on CM. I am still waiting for this money to be returned from the CSA. Should it take this long? I have phoned several times,just to be told its being dealt with.At first I was told the payment would come from the CSA coffers and they then claim back from PWC,when I phone now,i cant get a difinitive answer. Anybody else had experience of this?

  • We were told that while pwc claims ch/ben we had to pay.They were not interested in the legality of her claim only of our obligation to pay CM.So we got MP involved.We are still waiting for the outcome as Data protection prevents anybody giving details to anybody else ! It's a long old process but we are confident that we have very good evidence submitted . Good Luck with your case.It's not fair that the system can be manipulated in this way against compliant nrp's who have always supported their children. We are the ones who have a young child that needs supporting now!

    clevtrev, how have u gotten any organisation to listen to the fact that your ex was claiming cb when she wasnt entitled to it.

    cally, our mp cant help us any more due to data protection, hw have u gotten them to carry on fighting when ours cant
  • his wife ...we are still with the mp from the time we contacted him over 18 months ago.Every time we got a letter dismissing our claims we drafted a long letter based on the facts we had got from the helpful clips people had posted on here ,the links etc of the legislation that they have to follow and then argued our case based on it. Obviously they cant tell us any information themselves-that they have, but we know what the facts are & are focusing on that. I think it depends on which constituency you are in to how much the MP will help.Some have a lot of people to cover .We are hoping that we will set a precedent for future cases. Maybe you could contact him/her again if we have any success.

    I have emailed, mp, csa and cb weekly, the latter with not even an acknoweldegement, i have now resorted to email iain duncan smith, not yet received a reply from him either!!!! I can not beleive something so relatively simple and easy to check, has never been done, we have sent all proof and documentation, but again no reply. I have never ever known anything so frustrating as cb and csa ha ha

    That really is disgusting, one she's committing fraud claiming CB when she shouldn't and worse two they won't follow it up, so you end up paying CM when it is no longer payable, this makes me cross
  • Hi his wife, when I approached them to say I think there are no qualifying children anymore,they said they would look into it. I got a call back literally 15 mins later to say CB had stopped, but for 1 child it should have stopped months earlier! This is the money I am entitled to have back. When thats going to happen remains to be seen.

    Darna, we have had the same problem as cally, we can prove "child"wasnt in education yet, child benefit still ignored it. The government want to clamp down on fraud, yet they are allowing it too happen.Child benefit will not speak to the nrp , so therefor it is going to continue for ever!!

    Trev, i wish u all the luck in the world, i am both a pwc, and a nrpp, so i see both sides, yet i have never lied to get more money out of my ex! i hope it is resolved soon, i would reccommend you call them on a daily basis, to bug them, i mean remind them you still want your money back :)

    clevertrev - we have just gone through the exact same thing as you are experiencing now. We emailed a complaint (google csa complaints - there is a link to an online form) threatening them with our local MP, legal action etc and giving them 14 days to respond. I also outlined every lie that they had told my OH when he rang to chase his refund - basically so it was in black and white and on record that they were lying rather than dealing with the matter in hand. It has got the ball rolling for us, so to speak. Good luck, and keep on at them! You are probably of the same mind as me - I would give anyone my last penny, but I will not have it taken from me. When the CSA will not investigate on behalf of the NRP, especially when there is proof that the PWC is no longer entitled to the money, then they are effectively allowing fraud to be committed.
