shouldn't get income jsa if partner has enough contributions?

I'll try and make this brief. Me, dh and 21m old ds in household.
Nov: I put in jsa claim and started signing on as dh was suspended on suspicion of gross misconduct from full time job. Received nothing as I haven't paid enough contributions. Continued to sign just for credits to my NI.
Dec: dh has new job lined up but needs refs, so agreed to resign voluntarily in return for refs. I then told jobcentre and hmrc, started receiving income based jsa with him and ds as my dependants. This was easier in terms of paperwork, his upcoming job (end of jan to start) and avoiding resignation sanction. Updated hmrc when jsa payments started.
Jan: ton of errors on updated tax cred award so rang. Was told that I shouldn't get income based jsa as dh has plenty of contributions from previous FT job and I need to tell the jobcentre to stop my jsa immediately so that I'm not overpaid by hmrc or in trouble for lying to get income based benefits!
Is the hmrc woman right, or am I right that as my claim was in and we chose me to be the claimant while he was the primary childcarer for the time being it's fine for me to get income based?!
