Overtime and bonus pay

Hello

I was wondering if anybody would have any advice?

Over Christmas and new year because of "Christmas-itis" I ended up working over 48 hours to cover shifts. In our contracts if u work over 48 hours a week u get time and a half. Come Christmas Day and New Year's Day I was over the 48 hours, u get triple time for Christmas Day and double time for New Year's Day so essentially I should have been on triple time and a half and double time and a half. I've not had my wages yet but management seem to think I will only get the bonus pay and not the time and a half as well (work for a large chain). In our contracts it only mentions 48 hour time and a half nothing about bank holiday pay, and I've read the employee policy manual, again 48 hour rule but nothing about bank holiday pay.

In the contract it says "there are no premium payments for the first 48 hours worked in any week. Hours worked in excess of 48 hours in any week will be paid at time as a half "

So if I do only get the bonus pay and not the time and a half aswell can I contest it? It's a lot of money difference!

    I think this will need to be looked at carefully and will need full details of the contract. There may be other docs and custom and practice that clarify that may also need to be looked at.

    Still need the definition of a week, start and end,
    Typically this will be Sat-Fri, Sun-Sat or Mon-Sun(time sheet/pay system may have this). not sure what would be a default if none specified


    From what you have said so far you may be due a cumulative rate


    Often places have a cap that you get the highest enhancement due and they are not cumulative(Eg. NHS) this may be specified somewhere in the docs.

    Xmas and NY were mid(ish) week you must have worked long shifts to get over 48hr in those first few days.

    What does it specifically say about the enhanced rats for the holiday days.

    How long have you worked there?

    Under 2 years I would pick your battles carefully.

    That paragraph is literally everything in my contract re payment apart from the fact that they can change frequcency or method at their discretion. The whole contract is only 1.5 pages long! The employee handbook has the same paragraph and notice about frequency etc and again nothing else.

    Our week starts on a Thursday (weird ok know!) so as Xmas and new year were on a wed I was well into over 48 hours (did 65 over Xmas week and 84 over new year week - yes lots of double shifts!!)

    I can't find anything anywhere about only having one or the other and one of the managers has also looked an cannot find anything either. If it was only a few quid I wouldn't worry but it's a few hundre pounds difference!
